General terms and conditions – AllDriveParts

Article 1 – Definitions

In these terms and conditions:

Business: AllDriveParts, established at Zoutwinningsweg 20J, 7554 RP Hengelo (Ov), Chamber of Commerce number 97128570, VAT number NL005251481B91.

Customer: any natural or legal person acting in the exercise of a profession or business (business customer).

Agreement: any agreement between AllDriveParts and the customer concerning the supply of products.

Consumer: a customer who is a natural person and does not act in the exercise of a profession or business.

Article 2 – Applicability

These general terms and conditions apply to every offer by AllDriveParts and every agreement concluded between AllDriveParts and the customer. Deviations are valid only when agreed in writing. If one or more provisions are void or annulled, the remaining provisions remain fully in force.

These general terms and conditions apply exclusively to agreements with business customers (B2B). Agreements with consumers are expressly excluded.

Article 3 – Offer and agreement

All offers on the website are without obligation. The agreement is concluded when the offer is accepted and the stated conditions are met. AllDriveParts may refuse an order or impose additional conditions.

After an order is placed, AllDriveParts may contact the customer to check whether the ordered part fits the specified vehicle. The customer is responsible for providing correct vehicle information.

Article 4 – Prices and payments

The margin scheme applies to used goods under Dutch VAT law unless stated otherwise. In that case VAT is not shown separately on the invoice and is not deductible. If a product is not subject to the margin scheme, this is stated explicitly and prices exclude VAT unless stated otherwise.

Shipping costs are stated separately. Payment must be made using the offered payment methods. In the event of late payment, AllDriveParts may terminate or suspend the agreement.

Article 5 – Delivery

Delivery takes place at the address specified by the customer. AllDriveParts aims to dispatch within the indicated delivery time but is not bound by it. The risk of loss or damage passes to the customer when the products are handed to the carrier.

Article 6 – Returns and right of withdrawal

General. AllDriveParts mainly sells used original commercial vehicle parts. All parts are carefully inspected in advance. Any damage is clearly visible in product photos and marked with arrows, so the customer can see exactly what will be supplied. Returns are accepted only after consultation and written approval from AllDriveParts.

Business sales only (B2B). AllDriveParts sells exclusively to business customers. By placing an order, the customer expressly declares that they are acting in the exercise of their profession or business. AllDriveParts may request a Chamber of Commerce number or other proof of business activity. Consumers are excluded from purchasing. Consumer law, including the right of withdrawal, does not apply.

Article 7 – Warranty and conformity

AllDriveParts warrants that supplied parts correspond to the description on the website. The warranty expires in the event of incorrect or improper use, installation or modification. The customer must report a defect or error in writing within 48 hours after discovery.

Article 8 – Complaints procedure

Complaints or damage claims must be submitted in writing within 48 hours after receipt to info@alldriveparts.nl, stating the order number and including clear photos. AllDriveParts assesses the report and aims to provide a solution within 10 business days. Complaints and returns are not accepted without prior consultation and written approval.

Article 9 – Force majeure

AllDriveParts is not required to fulfil obligations in the event of force majeure, including failures, strikes, illness, supplier delays or other circumstances beyond its control.

Article 10 – Liability

AllDriveParts' liability is limited to the invoice amount of the product concerned. AllDriveParts is not liable for consequential, business or indirect loss unless caused by intent or gross negligence. Technical data and product information are provided to the best of our knowledge, but no rights can be derived from them.

Article 11 – Governing law

All agreements are governed exclusively by Dutch law. Disputes will be submitted exclusively to the competent court in the Overijssel district.
